1. Acceptance of Terms

These Terms and Conditions ("Terms") form a binding agreement between you and Off Great Neck Media ("Company," "we," "us," or "our") governing your access to and use of PreSnap Game and any related websites, applications, content, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial entertainment and educational use.

4. Intellectual Property

PreSnap Game, including all software, code, graphics, gameplay, plays, explanations, text, audio, design, logos, and other content, is owned by Off Great Neck Media and is protected by copyright, trademark, and other intellectual property laws. All rights are reserved. Except for the limited license expressly granted in these Terms, no rights are granted to you.

"PreSnap Game" and the PreSnap logo are trademarks of Off Great Neck Media. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works based on the Service or any portion of it without our prior written consent.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Cheat, exploit bugs, or use bots, scripts, or automated tools to interact with the Service or the leaderboard.
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or related systems.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Submit display names that are unlawful, defamatory, harassing, hateful, obscene, or that impersonate others.
  • Use the Service to harvest or collect information about other users.

We reserve the right to remove leaderboard entries, restrict access, or terminate your use of the Service for any violation of these Terms, in our sole discretion and without notice.

6. User-Submitted Content

By submitting a display name or any other content to the Service, you grant Off Great Neck Media a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, display, distribute, and modify that content in connection with the Service. You represent and warrant that you have all rights necessary to grant this license and that the content does not infringe any third-party rights.

7. Virtual Items and Scores

Any in-game scores, streaks, ranks, or leaderboard positions have no monetary value, are not redeemable for cash or other consideration, and may be reset, modified, or removed at any time without notice or liability.

8. Third-Party Services

The Service may contain links to or rely on third-party websites or services that are not owned or controlled by Off Great Neck Media. We are not responsible for the content, privacy policies, or practices of any third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OFF GREAT NECK MEDIA OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Off Great Neck Media and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.

13. Changes to the Service or Terms

We may modify or discontinue the Service, or any feature of it, at any time without notice or liability. We may also revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction and venue there.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Off Great Neck Media regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
